an encore presentation tonight  he was a party out of control Blues brawls then a blast of gunshots  a young man jazz as police race to solve the crime before the trail goes cold 4:30 in the morning we have a murder to go to the interrogation room is the right man on trial or could someone be playing the police the boss always a clever then and explosive moment in court that turned everything side down anything can happen Josh mankiewicz with the party's over  thank you for joining us Ann Curry it started in the street on a hot Summer's night more than 100 young people at a party that went on for hours but it ended in seconds with 11 gun show who pulled the trigger or about to take you inside and murder case it all unfolds before our cameras as we Trail the detectives who did more than work this crime they lived it hears Josh mankiewicz this murder happens on September 2nd 2002 the Labor Day weekend was a large part of the house with a poison 100 people  there was a breakup of the the car and start to drive away and she says that's when a man in a red jersey came out of the house and block their path we're on got out of the car and an argument broke out Erica says she saw a dark skin man come up and hand a gun to the man on the red jersey and everybody started running assault victim Michael Barone falls on the ground at that point she ran to her car as she was driving away she saw the homeowner drive up and his white Honda and some guy pulled up next with some looked at him and it was him and then I was like oh my god get the license plate number only knows the Man's first name Leo sounds like a pretty good witness sounds to me like she remember what you saw she told me that she didn't drink that night  Heather another the victim Michael Barone was also there when the shooting started she tells virtually the same story is Erica Leo the guy in the red jersey was the shoe see you at the party what happened  I love you  Heather tells me that she hears wpial a homeowner in the red jersey say hand me the gun and then let's plastic and I remember seeing the guy in the red shirt have the gun and just pointing out here that I seem like you know Sparks and two witnesses to say he's the one who did it so we're pretty confident we can solve this case  Detective Dee add shoulder the homeowner is the killer it's been 5 hours since the killing and detectives need to track down the man named Leo to do that they have to find out he's type of call Caruso's processing the scene he is checking the registration of vehicles front of the hall one of square with me me my friends are real my house ride somebody started trashing my room I know he was mad he's got a motive he was upset with the victim trashing the bedroom I'm pretty confident of telling me he didn't do it don't know who shot you know we got video tape we know what was going on inside the house everybody who and he doesn't know who did I don't believe what he's telling me I feel that he's hiding things he's holding back I can front them turn off right now to book you for murder  if you didn't do the shooting and you going to have to turn over the guy who did all right don't want to go to jail for something you didn't do it I'm getting frustrated I can't get him to confess you know the guy that was there with the gun don't protect them I don't know I'm not time for interview you get to a point where you have to take a break frustrated from Leo's interview I feel him in on what Kirby at told me about how the shooting occurred this is victim number one give me a picture of Kirby statement just a few feet in front of Leo and that mysterious dark skinned man but Kirby says he's positive that Leo never pulled a gun and that when shots were slash is it come from the hand of the dark skinned man not from Leah that's just the opposite of what two other Witnesses Heather and Erica had told the tech I still think he is they're frustrated because he won't I is a dark-skinned shooter they decide it's time to turn up the heat I'm going to send Alex in to talk to the Leo and good cop bad cop I wanted to use the video tape that recovered the video is Mike Barone and him hitting each other and being very friendly you know this guy is you don't know the sky you were drinking Lila still fighting it the truth go back information Alex knows it I know it  because with the hardware  does he get the Google I confronted the manager one more time telling him the seriousness of this crime he finally told me that he and Johnny were friends they had gone to high Johnny Johnny is the truth or is he still hiding something have a good day right now I have feeling totally lost  I know I have the right Johnny Leo is my stumbling block I don't know why he's lying front of him think of Alex media says you were friends I think that Leo was afraid of Johnny Campos and that was the reason that he was so hesitant and giving him up he's a killer the person in Cold Phoenix Police Headquarters interrogation this guy he trashed Leo Leo confronts guy outside then it is a shooting where am I wrong cuz you had the right person to start Leo angry been trashed it could Campos was not guilty instructions of law turn to the family and I tell him it's up to the jury we just have to sit back and wait to see what happens  you still think you got the right man I'm sure of it the verdict when the party's over continues count 1 seconds 2002 you still think you got the right man I'm sure of it I'm one-hundred-percent I did so much work  but now everything is drained out of me Johnny Campos is convicted of who won of beat possession I'll be going to prison but it's not it's not the same as a conviction for murder was the wrong man on trial here with the case against Leo stronger than the case against it would have been the same thing we would have had witnesses that said Leo did it Witness Leo didn't do it the defense would have just reversed roles Johnny was the shooter yes how good Kirby was when I took his statement it was the wrong guy on trial anything that says Leo did anything wrong other than possess a weapon Johnny Campos was sentenced to seven and a half years on the illegal weapons charge but the sentence was reduced to five years and on October 26th 2007 Campos was released from prison to serve the remainder of his sentence under you just don't do a case  and file it you you live with these cases specially the cases turn off keep investigating and look for the real shooter no charges were filed against Lee Ortiz you can still believe he was only a witness to the killing the case is officially closed
